AFFILIATE AGREEMENT

entered into the day of the registration of the person joining the affiliate system between:

Sewer Niedźwiecki Sacred Forest, Tadeusza Kościuszki Street, 81-704 Sopot, NIP:581500774, hereinafter referred to as the Company,

and

A participant in the affiliate program confirming their identity with the affiliate form, hereinafter referred to as the Affiliate,

  • 1 Definitions
  1. Crystal Harp: A musical instrument of the Sacred Forest brand, consisting of crystal tubes mounted on a frame, designed by Sewer Niedźwiecki, protected by copyright, property, and patent law.
  2. Affiliate System: A system built into the sacredforest.pl website, which is used to generate individual codes and affiliate links. Its purpose is to determine whether a customer making purchases on the sacredforest.pl website was directed there by a Participant in the Affiliate System.
  3. Promotional Materials: Digital marketing materials available to Participants in the Affiliate System in the “creatives” section on the sacredforest.pl website.
  4. Discount Code: A unique code generated individually for each Participant in the Affiliate System by the administrator of the sacredforest.pl website. This code is used to identify customers referred by the Affiliate, with a certain margin value assigned to the code. The code can also contain a discount value for the customer.
  5. Affiliate: A person or company that has registered in the Affiliate System on the sacredforest.pl website. If the Affiliate conducts business activity, they can apply for payment of the margin due to them based on the invoice issued. If the Affiliate does not run a business, they can apply for the equivalent of the margin in the form of a credit to be used for purchases of products on the sacredforest.pl website.
  • 2 Subject of the contract
  1. The Company entrusts the Affiliate with the performance of work involving intermediation in the sale of the crystal harp. The Affiliate undertakes to promote the sacredforest.pl website and crystal harps of the Sacred Forest brand and to perform the work in a correct, careful manner and in accordance with the good image of the Sacred Forest brand.
  2. The Affiliate receives remuneration in the amount set in the individually generated discount code value of the net sale of the crystal harp, for which they intermediated.
  • 3 Duration of the contract
  1. The agreement is concluded for an indefinite period.
  2. The Company has the right to withdraw from the contract at any time. Informing the Affiliate to the email address provided when logging into the affiliate system.
  3. The Affiliate has the right to withdraw from the contract at any time. Informing the Company at the email address hello@sacredforest.pl.
  • 4 Settlement principles
  1. Settlement between the Company and the Affiliate is based on an invoice issued by the Affiliate, or in the form of a credit on the website that can be used for purchases at www.sacredforest.pl.
  2. The Affiliate is obliged to settle the income tax independently from the received remuneration.
  3. The margin from the sold harp is due no earlier than 30 days after the date of delivery of the sold harp to the customer, of the Sacred Forest online store.
  4. If for any reason the customer does not receive the sold harp, returns it within the 14 days to which they are entitled, returns the harp on the basis of a complaint, or the Company does not receive the amount due for the sale, the margin will not be due to the Affiliate.
  • 5 Liability of the parties
  1. In the event of non-performance or improper performance of the contract, the parties are liable on general terms.
  2. The Affiliate will not use the promotional materials provided to them in any way that could harm the Company or damage the good name of the Sacred Forest brand.
  3. The Affiliate will not use the materials provided to them by the Company after the termination of the agreement.
  4. The Affiliate undertakes to remove within a period not exceeding 14 days the content related to the Sacred Forest brand at the request of the Company if it considers that they are not in accordance with the brand’s policy.
  • 6 Copyright owner:
  1. The Company confirms that the photo, video, logo, and other materials provided for the duration of the agreement are covered by copyright and property rights, which remain the exclusive property of the Company.
  • 7 Final provisions
  1. In matters not regulated by this agreement, the provisions of the Civil Code shall apply.
  2. This agreement is subject to Polish law, and any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts competent for this country.
  3. In case of disputes arising from this agreement, the parties undertake to try to resolve them through negotiations and mediation. In case of inability to reach an agreement, the dispute will be settled by the court competent for the Producer’s registered office.
  4. The Company reserves the right to make changes to the agreement. The Affiliate will be informed about all changes by email, to the address used when registering on the sacredforest.pl website.
  5. By registering for the affiliate system on the sacredforest.pl website, the affiliate confirms that they have read the regulations and accept its content.
  6. The Affiliate confirms that the data entered by them in the registration form are true.
